Rollfast Waiver

WAIVER, RELEASE FROM LIABILITY, AND ASSUMPTION OF RISK

As a participant in the Rollfast events and camps, I verify that I have read, understand, and accept the terms of this waiver and release. I understand the nature of this event and the inherent risks involved in participating in this cycling event. I know that cycling on controlled and open roads is a potentially hazardous activity. I understand that I should not participate unless I am medically able and sufficiently trained to do so. I agree to abide by any decision of any event official concerning my ability to safely compete in this event. I understand that while some police protection will be provided, there may still be traffic on the course. I assume all risks associated with my voluntary participation in this event, including, but not limited to, traffic and other conditions of the road, surface hazards, falls, contact with other participants, collisions with pedestrians, vehicles and other objects, equipment failure, and the effects of the weather, including extreme temperatures and precipitation.

Knowing and agreeing to the foregoing, and for, and in consideration of, my participation in this event, I, for myself, my heirs, executors, administrators, or anyone else who might claim on my behalf, covenant not to sue and fully release and forever discharge Rollfast, Rollfast Cycling, Rollfast, Inc., the city of Carmel, race participants, race officials, sponsors, promoters, property owners, workers, volunteers, and any and all officers, directors, employees, agents, successors, assigns, or other representatives of the foregoing, and agree to indemnify, hold and save all of them harmless from and against ANY AND ALL actions, claims, injuries, demands, liabilities, loss, lost income or earning capacity, medical expenses, reasonable attorney’s fees, damage, or expenses, of whatever kind or nature, including but not limited to death, disability, personal injury, and property damage, whether foreseen or unforeseen, known or unknown, arising out of, directly or indirectly, any negligence, act or omission of any such organization or person, or in the course of, my participation in this event. The above has been read by the participant and by signing this entry form, I understand and agree with all terms of this Waiver, Release from Liability, and Assumption of Risk.

Release to Photograph, Record, and License

I agree to grant Rollfast and The City of Carmel, Indiana (the “City”), acting through its agents, employees, or representatives, to take photographs, video recordings, and/or audio recordings of me, including my name, my image, my likeness, my performance, and/or my voice (“Recordings”). I hereby grant the City an unlimited right to reproduce, use, exhibit, display, perform, broadcast, create derivative works from, and distribute the Recordings in any manner or media now existing or hereafter developed, in perpetuity. I agree that the Recordings may be used by the City, including its assigns and transferees, for any purpose, including but not limited to, marketing, advertising, publicity, or other promotional purposes, without payment to me. I waive the right to inspect or approve the finished product, including written or electronic copy, wherein any of the Recordings appear. I understand that the Recordings will be copyrighted in the name of the City or Rollfast and may be used in conjunction with other Recordings, as part of a composite, or in any form whatsoever. My participation in allowing use of the Recordings hereunder in publications, including without limitation, web sites, is voluntary, confers upon me no rights of ownership or copyright in the Recordings whatsoever, and I further waive any right to royalties or other compensation arising from or related to the use of the Recordings. I certify that I am eighteen (18) years of age or older and I understand all the foregoing terms and conditions and fully give my consent thereto.

  • I understand that this is a legal document with defects that I approve and authorized.
  • I have completed the Application to compete in the cycling event as a participant, which Application is incorporated by reference.
  • I am authorized to agree to the terms of this document on behalf of the registrant.
  • If the registrant is under 18 years of age, incapacitated or mentally challenged, I assert that I am the parent/legal guardian or otherwise authorized to execute a legally binding agreement on behalf of the registrant.
